PORTAL VISITORS SOFTWARE LICENSE TERMS

These license terms are an agreement between Portal Visitors - referred to as "licensor" and you. Please read them. They apply to the Portal Visitors Software - referred to as "software". By using the software, you accept these terms. If you do not accept them, do not use the software. If the software was accessed electronically, click “Disagree/Decline”.

The software is owned by Portal Visitors and is protected by copyright laws and international copyright laws and treaties, as well as other intellectual property laws and treaties.

3. License Model. The software is licensed per one DNN installation. You have to purchase one license for each DNN installation with the software installed.

4. Evaluation Use Rights. If you have not purchased or otherwise legally obtained a license for the software then the Evaluation Use Rights described in this section apply to your use of the software:

5. Working with Licenses. If you want to use the software after the evaluation period, you have to purchase one license for each DotNetNuke installation with the software installed. You may purchase the Portal Visitors Software online from the DotNetNuke Store website at store.dotnetnuke.com. When you purchase the Portal Visitors Software at the DotNetNuke Store, the DotNetNuke Store provides you an Invoice Number. Using this Invoice Number, you may request the license file from the Portal Visitors official website by filling an online form at www.portalvisitors.com/buy. You will receive an email containing the license file corresponding to the DNN GUID that you have provided within 48 hours after your license request. Please specify a valid email address when purchasing the license as it will be used to send you the license file. This email will also contain all necessary instructions on entering the license information into the software.

6. Use Rights. One license allows you to use the software on an unlimited number of DNN Portals composing ONE (1) DNN installation.

7. Scope of License. The software is licensed, not sold. This agreement only gives you some rights to use the software. The licensor reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. You may not rent, lease, lend, sell, redistribute or sublicense the software. You may not reverse engineer, decompile, disassemble, modify, or create derivative works of the software, except and only to the extent that applicable law expressly permits, despite this limitation. Any attempt to do so is a violation of the rights of the licensor. If you breach this restriction, you may be subject to prosecution and damages. These license terms will govern any upgrades provided by Portal Visitors that replace and/or supplement the original software, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

8. Documentation. Any person to whom you have granted access to the software may copy and use the documentation for your internal, reference purposes.

9. Consent to Use of Data: You agree that the Portal Visitors may collect and use technical data and related information, including but not limited to technical information about your server hardware, system and application software, and peripherals, gathered as part of the product support services provided to you, if any, related to the software. Portal Visitors may use this information to improve its products or to provide services or technologies to you and will not disclose this information in a form that personally identifies you.

10. DISCLAIMER OF WARRANTY. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF SATISFACTORY QUALITY, OF ACCURACY, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION

11. Limitation of Liability. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE LICENSOR OR THE AUTHORS BE LIABLE FOR PERSONAL INJURY, OR ANY GENERAL, INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF THE LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Termination. The agreement is effective until terminated by you or the licensor. Your rights under this agreement will terminate automatically without notice from the licensor if you fail to comply with any term(s) of this agreement. Upon termination of the agreement, you shall cease all use of the software.

13. Entire Agreement. This agreement constitutes the entire understanding and agreement between the licensor and you for the software.
